Terms & conditions
These are the terms on which Gas Worx (Southampton) Ltd quotes for and carries out work at your property.
These terms apply to contracts between you and Gas Worx (Southampton) Ltd, company number 10599273, VAT number 266503696, registered at 6 Prince Maurice House, Cavalier Court, Bumpers Way, Bumpers Farm, Chippenham, Wiltshire SN14 6LH (“Gas Worx”, “we”, “us” or “our”).
They should be read alongside your quotation, proposal and any other documents we provide for the specific work.
Nothing in these terms affects your statutory rights as a consumer.
1. Quotations and estimates
A quotation is our price for the work specifically described in it, subject to any assumptions, exclusions or conditions stated in the quotation.
An estimate, including a figure produced by an online estimate or pricing tool, is an indication of likely cost based on the information available at the time. It is not a fixed quotation or an offer to carry out the work at that price.
Unless stated otherwise, quotations are valid for 30 days.
Our quotation is based on the condition of the property and systems that we can reasonably inspect before work begins. If we discover something that could not reasonably have been identified beforehand, such as concealed or unsafe pipework, wiring, structural issues or other hidden defects, we will explain what we have found and any additional work required.
We will not carry out chargeable additional work without discussing it with you first.
2. Your contract with us
Your contract will consist of these terms together with your accepted quotation or proposal and any specifications, designs or other documents expressly included with it.
Where the quotation or proposal contains terms specific to your project, such as the price, payment schedule, equipment, performance specification or scope of work, those project-specific terms will apply to that work.
Any changes agreed after the contract is formed should be confirmed in writing.
3. Appointments and surveys
Initial consultations are free unless we tell you otherwise beforehand and place you under no obligation to proceed.
Some work will require a physical survey, technical assessment or design before we can provide or confirm a fixed quotation.
Where we agree an installation or appointment date, we will confirm it with you. Please tell us as early as possible if you need to change an appointment.
Occasionally we may need to rearrange work because of circumstances outside our reasonable control, including severe weather, illness, supplier delays or an emergency affecting another customer. If this happens, we will contact you as soon as reasonably possible and arrange a new date.
4. Access to your property
You agree to provide safe and reasonable access to the property and to the areas required to carry out the agreed work.
Unless agreed otherwise, you should also ensure that we have reasonable access to electricity and water where these are required for the work.
Please tell us before work begins about anything that may affect the safety or practicality of the installation, including known asbestos, structural problems, unsafe electrical systems, restricted access or other hazards.
We may stop or postpone work if we reasonably believe it would be unsafe to continue.
5. System design and suitability
Where the work requires a technical design, we will assess the property and design the system based on the information reasonably available to us.
For heat pumps, solar and other renewable-energy systems, estimated performance, generation, savings, running costs or similar figures are forecasts rather than guarantees unless we expressly state otherwise in writing.
Actual results can be affected by factors outside our control, including weather, energy prices and tariffs, household behaviour, occupancy, system settings and changes made to the property after installation.
Where a specific Gas Worx performance guarantee applies, its target, qualifying criteria, measurement method and operating conditions will be set out separately in writing.
6. Price and payment
The price for the work and the applicable payment terms will be shown on your quotation or proposal.
If a deposit, staged payments or final balance are required, the amounts and due dates will be stated there.
Unless we agree otherwise in writing, additional work requested by you after the quotation has been accepted may result in an additional charge. We will explain the cost before carrying out that additional work.
Finance agreements are separate agreements with the relevant lender and are subject to their own terms, eligibility requirements and approval. Gas Worx (Southampton) Ltd is an Introducer Appointed Representative of Ideal Sales Solutions Ltd, t/a Ideal4Finance. Ideal Sales Solutions Ltd is a credit broker and not a lender (FRN 703401). See our finance page for the options available.
7. Boiler Upgrade Scheme and other funding
Where your proposed installation may qualify for the Boiler Upgrade Scheme, we will explain the funding we believe may be available based on the information provided to us.
Where required, Gas Worx will make the voucher application on your behalf and you will be asked to provide any information, consent or verification required by the scheme administrator.
Where a Boiler Upgrade Scheme grant is being used, the applicable grant value will be shown as a deduction from the price of the eligible installation.
Eligibility and payment of funding are determined under the rules of the scheme and are not controlled by Gas Worx.
You agree to provide accurate information and complete any consent or verification steps reasonably required for the application.
If funding is refused, withdrawn or reduced for a reason outside our reasonable control, we will explain the position and any effect this has on your project before proceeding further.
8. Changes to the work
Sometimes you may ask us to change the specification after accepting the quotation, or circumstances discovered during the work may mean that a change is necessary.
Where a change affects the price, equipment, design or timescale, we will explain this to you and agree the change before carrying out the additional work wherever reasonably possible.
Minor changes that do not materially affect the agreed system, performance or price may be made where reasonably necessary to complete the installation safely and professionally.
9. Cancellation rights
If you are a consumer and your contract is entered into online, by telephone or away from our business premises, you may have a statutory right to cancel the contract within 14 days, subject to the applicable consumer legislation and any exceptions.
We will provide the required cancellation information where those rights apply.
If you specifically ask us to begin providing services during the cancellation period and then cancel after work has begun, you may be required to pay a reasonable amount for the work supplied up to the point at which you told us you wished to cancel.
Any additional cancellation arrangements applying to your particular project will be stated in your quotation or contract documents.
10. Installation and completion
We will carry out the agreed work with reasonable care and skill and in accordance with the applicable professional and regulatory requirements.
We will take reasonable care of your property while working and will leave the working area reasonably clean and tidy when the installation is complete.
On completion, we will provide the relevant documentation for the work where applicable. This may include commissioning information, certificates, warranties, operating instructions and other records required for the particular installation.
11. Manufacturer warranties
Where equipment is supplied with a manufacturer warranty, we will provide or register the relevant warranty information where registration forms part of our service.
Manufacturer warranties are provided by the manufacturer and are subject to that manufacturer’s own terms and conditions.
Many warranties require servicing or maintenance at specified intervals. It is your responsibility to ensure those requirements are met, although Gas Worx may offer servicing or a care plan to help you manage them.
Any workmanship guarantee provided directly by Gas Worx will be subject to the period, scope and conditions stated in your quotation, proposal or guarantee documentation.
12. Care plans and servicing
Care plans and ongoing maintenance services may be subject to additional terms specific to the plan you choose.
We will explain what is included, the price and any applicable exclusions or cancellation arrangements before you take out a plan.
A care plan does not replace or extend a manufacturer’s warranty unless expressly stated.
13. Your responsibilities
You agree to provide information that is accurate to the best of your knowledge and to tell us about anything you become aware of that could materially affect the work.
After installation, you are responsible for using and maintaining the equipment in accordance with the instructions provided and for arranging any servicing required to maintain applicable warranties.
We are not responsible for faults or reduced performance caused by misuse, unauthorised alterations, failure to maintain the system, work carried out by third parties or circumstances outside our reasonable control.
This does not affect your statutory rights or our responsibility for work carried out by us.
14. Delays outside our control
We will make reasonable efforts to complete work within any timescale agreed with you.
We are not responsible for delays caused by events outside our reasonable control, such as severe weather, supply-chain disruption, manufacturer delays, utility or network-provider requirements, access problems or unexpected conditions at the property.
If a significant delay occurs, we will keep you informed and explain what happens next.
15. Our responsibility to you
We are responsible for loss or damage you suffer where it is a foreseeable result of our breach of contract or our failure to use reasonable care and skill.
We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or other liability that cannot legally be excluded.
Nothing in these terms limits the rights or remedies available to you under consumer law.
16. Complaints
If something is not right, please tell us so we have the opportunity to put it right.
You can contact us at:
Email: Team@gas-worx.co.uk
Telephone: 02381 550139
We will acknowledge your complaint and explain the next steps.
We are Gas Safe registered (502860), a NAPIT member (70593) and MCS certified for heat pump installations (certificate NAP-70593).
For heat pump installations, we are members of HIES (the Home Insulation & Energy Systems Contractors Scheme), a consumer code approved by the Chartered Trading Standards Institute. If we can’t resolve a complaint about a covered installation, you can use HIES’s independent dispute-resolution service. Where your work is covered by another certification scheme or consumer code, we will give you its details.
17. Personal information
We use personal information in accordance with our Privacy Policy.
We may also need to share relevant information with manufacturers, certification bodies, scheme administrators, finance providers or other parties where necessary to provide the service you have requested, register warranties, obtain certification, process funding or meet our legal and regulatory obligations.
18. Governing law
These terms are governed by the laws of England and Wales.
If you are a consumer, you may bring legal proceedings in the courts available to you under applicable consumer law.
